1. Acceptance of Terms
By accessing or using the QuandoPosso services ("Service"), operated by QuandoPosso ("we", "our", "us"), you ("User", "you") agree to be bound by these Terms of Service. If you do not agree to any part of these terms, you should not use the Service.
These Terms of Service constitute a legally binding agreement between you and QuandoPosso. By creating an account, accessing, or using any part of the Service, you acknowledge that you have read, understood, and agree to comply with these Terms in their entirety. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
We may provide additional terms or policies for specific features of the Service. Such additional terms supplement and form an integral part of these Terms of Service.
2. Description of Service
QuandoPosso is an online scheduling platform designed for professionals who want to simplify the management of their appointments. The Service allows you to create personalized booking pages, manage your availability, and receive bookings from your clients in an automated manner.
Key features. The Service offers the following features, which may be expanded or modified over time:
- Personalized booking page: A unique, public link where your clients can view your availability and book appointments directly
- Availability management: Full control over your available time slots, event types, and session durations
- Google Calendar synchronization: Bidirectional integration with your Google Calendar to prevent scheduling conflicts and keep your calendar in sync
- Notifications and reminders: Automatic delivery of confirmations, reminders, and updates via email to both you and your clients
- Contact profiles: Organized record of your clients with a complete booking history and contact information
We reserve the right to modify, suspend, or discontinue any feature of the Service, either temporarily or permanently, with reasonable advance notice whenever possible.
3. User Account
Account creation. To use the Service, you must create an account using Google authentication (Google OAuth). By doing so, you authorize access to your basic Google profile information, as detailed in our Privacy Policy.
Account responsibility. You are fully responsible for maintaining the confidentiality and security of your account, including all activities that occur under your credentials. You agree to notify QuandoPosso immediately if you become aware of any unauthorized access to or misuse of your account.
Accuracy of information. You agree to provide truthful, accurate, and up-to-date information when creating and maintaining your account. False or misleading information may result in the suspension or termination of your account.
One account per person. Each individual or legal entity must maintain only one account. Creating multiple accounts for the same user or entity is prohibited.
4. Acceptable Use
By using the Service, you agree to act in good faith and to respect the rights of other users and of QuandoPosso. You agree not to use the Service for the following purposes:
- Unlawful activities: Violating any applicable laws, regulations, or standards, whether national or international
- Offensive content: Publishing, transmitting, or sharing content that is illegal, abusive, defamatory, obscene, threatening, or otherwise offensive
- Service interference: Interfering with or disrupting the integrity, security, or performance of the Service, including denial-of-service attacks or reverse engineering
- Unauthorized access: Attempting to access restricted areas of the Service, systems, servers, or networks without express authorization
- Improper data collection: Collecting, storing, or processing personal data of other users or their clients without adequate consent and legal basis
- Spam and unsolicited communications: Using the Service as a tool for sending spam, unsolicited bulk messages, or any form of unauthorized commercial communication
- Misrepresentation: Impersonating another person, entity, or representative of QuandoPosso
QuandoPosso reserves the right to investigate and take appropriate action, including suspension or termination of accounts, in the event of a violation of this section.
5. Payments and Subscription
Plans and pricing. The Service is offered as a paid plan with monthly (R$ 10/month) or annual (R$ 100/year) billing options. Prices are in Brazilian Reais (BRL) and may be changed with 30 days' advance notice. Price changes do not affect the current billing period already contracted.
Payment processing. All payments are processed by Stripe, our payment processing partner. By subscribing, you authorize recurring, automatic charges to the payment method provided (credit card or other method accepted by Stripe). QuandoPosso does not directly store your complete card details.
Cancellation. You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period, and you will continue to have access to the Service until the end of that period. We do not offer prorated refunds for partial periods of use.
Billing failures. In the event of a billing failure, we may retry the charge within a reasonable timeframe. If payment is not resolved, access to the Service may be suspended until the situation is regularized.
Promotions and free trials. From time to time, we may offer promotions, coupons, or free trial periods. The specific terms of each offer will be communicated at the time of its availability and do not alter the remaining terms of this section.
6. Intellectual Property
QuandoPosso's rights. The Service, including its source code, design, interface, logos, trademarks, text, graphics, and all other features, are the exclusive property of QuandoPosso or its licensors and are protected by Brazilian and international intellectual property laws. Reproduction, modification, distribution, public display, or creation of derivative works without the express written authorization of QuandoPosso is prohibited.
Your content. You retain all ownership rights to the content you submit, enter, or transmit through the Service. By using the Service, you grant us a worldwide, non-exclusive, royalty-free, limited license to use, host, store, and display your content solely for the purpose of operating and providing the Service to you.
Feedback. If you send us suggestions, ideas, or feedback about the Service, you agree that we may use them freely for any purpose, without any obligation of compensation or attribution.
7. Privacy and Data
The collection, use, storage, and processing of your personal data are governed by our Privacy Policy, which is an integral part of these Terms of Service. By using the Service, you acknowledge that you are aware of and agree to the practices described in that Policy.
You acknowledge that, as a professional using the Service to receive bookings, you may act as a data controller with respect to the personal data of your own clients. It is your responsibility to ensure that the collection and use of such data comply with applicable data protection legislation, including the LGPD.
8. Service Availability
Availability levels. We strive to keep the Service available 24 hours a day, 7 days a week, but we do not guarantee uninterrupted or error-free availability. The Service may experience interruptions due to factors beyond our control, such as third-party infrastructure failures, security incidents, or natural disasters.
Maintenance. We may perform scheduled or emergency maintenance that may result in temporary unavailability of the Service. Whenever possible, scheduled maintenance will be communicated in advance and performed during off-peak hours.
No guarantee of results. QuandoPosso does not guarantee that the Service will meet all of your specific business requirements or expectations. Use of the Service is at your own risk.
9. Limitation of Liability
Disclaimer of warranties. The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of damages. To the fullest extent permitted by applicable law, QuandoPosso, its directors, employees, partners, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunities, business interruption, or damages resulting from the use of or inability to use the Service.
Maximum liability cap. Under no circumstances shall QuandoPosso's total liability to you exceed the total amount paid by you to QuandoPosso in the 12 months preceding the event giving rise to the claim.
10. Termination
Termination by QuandoPosso. We may suspend or terminate your account and access to the Service at any time, with or without cause, upon reasonable advance notice. In cases of serious violation of these Terms, suspension or termination may be immediate, without prior notice.
Termination by you. You may terminate your account at any time by accessing the Service settings and requesting account deletion. If you have an active subscription, account deletion also cancels the subscription, with no right to a prorated refund.
Effects of termination. Upon account termination, your right to access and use the Service ceases immediately. Data associated with your account will be handled as described in our Privacy Policy and may be deleted within 30 days of termination. Provisions of these Terms that, by their nature, should survive termination (such as limitation of liability and intellectual property) shall remain in effect.
11. Changes to Terms
We reserve the right to modify these Terms of Service at any time, at our sole discretion. When we make significant changes, we will notify you via email or a prominent notice on the Service at least 15 days in advance before the new terms take effect.
Continued use of the Service after the changes take effect constitutes express acceptance of the new terms. If you do not agree with the changes, you should stop using the Service and request the termination of your account.
12. Governing Law and Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of the Federative Republic of Brazil, particularly the Consumer Protection Code (Law 8,078/1990), the Brazilian Internet Framework (Law 12,965/2014), and the General Data Protection Law (Law 13,709/2018).
Any controversy or dispute arising from these Terms or the use of the Service shall be submitted to the courts of the district of São Paulo, State of São Paulo, to the exclusion of any other, however privileged.
